1. Agreement to these Terms

These Terms of Use (“Terms”) govern your access to and use of the Promise Fitness™ website, community and related services that link to these Terms (collectively, the “Service”). In these Terms, “Promise Fitness”, “we”, “us” or “our” refers to Promise Fitness™. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What Promise Fitness is

Promise Fitness is a fitness accountability and encouragement community built around making realistic personal commitments, tracking consistency and encouraging others. It is not a healthcare provider, medical service, emergency service, dietetic practice or substitute for qualified professional advice.

3. Eligibility and responsibility

You must be legally capable of agreeing to these Terms in your jurisdiction. If you are under the age of majority where you live, you should use the Service only with the involvement and permission of a parent or legal guardian. You are responsible for deciding whether any activity is appropriate for your circumstances and for complying with the rules of third-party platforms you use to access the community.

4. Community standards

We want Promise Fitness to remain welcoming and useful. You must not use the Service to harass, threaten, shame or discriminate against others; encourage dangerous exercise, disordered eating or self-harm; impersonate others; distribute unlawful, deceptive, abusive or infringing material; spam or solicit members without permission; collect or expose another person’s private information; introduce malware or interfere with the Service; or use the community for unlawful purposes.

Fitness levels, bodies, abilities and goals differ. Community challenges are intended to support participation and personal progress, not unsafe competition.

5. Your promises, goals and participation

You choose your own fitness commitments. Promise Fitness does not guarantee that a particular promise, challenge, activity or routine is safe or suitable for you, or that participation will produce any particular fitness, health, weight, appearance or performance outcome. “PromiseFit™” describes our accountability concept and recognition standard; it is not a medical diagnosis, health certification or guarantee of physical fitness.

6. User content

You remain responsible for text, photos, check-ins, goals and other material you post or submit (“User Content”). Do not post content you do not have the right to share. Avoid posting sensitive personal or medical information in public or group spaces.

You retain ownership of your User Content. To the extent you submit content directly to Promise Fitness for display, moderation or operation of the Service, you grant Promise Fitness a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content only as reasonably necessary to operate, moderate and promote the Service in the context in which you submitted it. We will seek additional permission before using an identifiable member photo or testimonial in unrelated advertising where consent is required.

7. Moderation

We may moderate, restrict, remove or decline content or participation where we reasonably believe it violates these Terms, community rules, applicable law, platform requirements or the safety and integrity of the community. We may suspend or remove participants where reasonably necessary. We are not required to monitor every message or item of User Content.

8. Intellectual property

The Service, its original content, branding, software and design are protected by applicable intellectual-property laws. Promise Fitness™ and PromiseFit™ are claimed marks used by Promise Fitness™. Nothing in these Terms grants you a right to use our names, marks, logos or other brand assets except as expressly authorised in writing or as permitted by law.

9. Third-party services

The Service may link to or operate alongside third-party services, including WhatsApp. Those services are provided by third parties under their own terms and privacy policies. Promise Fitness does not control and is not responsible for the availability, security, content or independent practices of third-party services.

11. Health and fitness disclaimer

Exercise and lifestyle changes can involve risk. You are responsible for using reasonable judgement and obtaining qualified medical or other professional advice when appropriate, particularly if you have symptoms, an injury, a medical condition, are pregnant, are returning after a long period of inactivity, or are uncertain whether an activity is suitable for you. 12. No guarantees

We aim to provide a useful and supportive Service, but the Service is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee uninterrupted availability, error-free operation, particular results, or that community information will always be accurate, complete or suitable for your circumstances.

13. Limitation of liability

To the fullest extent permitted by applicable law, Promise Fitness and its owners, personnel and service providers will not be liable for indirect, incidental, special, consequential or punitive damages, or loss arising from reliance on community content, third-party services or voluntary fitness activities. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or any mandatory consumer rights that apply to you.

14. Indemnity

To the extent permitted by law, you agree to be responsible for losses, claims or reasonable costs arising from your unlawful misuse of the Service, your infringement of another person’s rights, or User Content you submit in violation of these Terms. This section does not apply to the extent prohibited by applicable consumer law.

15. Changes, suspension and discontinuation

Promise Fitness is developing. We may add, change, suspend or discontinue features and may update these Terms. Material changes will be identified by an updated date and, where required, additional notice. Continued use after revised Terms take effect constitutes acceptance only to the extent permitted by applicable law.

16. Governing law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-laws principles, except to the extent mandatory law in your place of residence gives you rights that cannot lawfully be waived or displaced. Nothing in this section deprives a consumer of protections or forums that applicable law requires to remain available.

17. Severability and entire agreement

If a provision of these Terms is held unenforceable, it will be interpreted or limited to the minimum extent necessary and the remaining provisions will continue in effect. These Terms, the Privacy Policy, the Health & Fitness Disclaimer and any clearly identified community rules form the agreement governing the parts of the Service to which they apply.
